| 1 |  |   (1) a person who possesses a license to manufacture  | 
| 2 |  |  firearms under subsection (a) of Section 923 of the federal  | 
| 3 |  |  Gun Control Act of 1968 (18 U.S.C. 923(a)); | 
| 4 |  |   (2) a person who is actually engaged in the business of
 | 
| 5 |  |  manufacturing and selling any piece or part of a firearm,  | 
| 6 |  |  but only with respect to the
activities which are within  | 
| 7 |  |  the lawful scope of that business; or  | 
| 8 |  |   (3) a person who uses a three-dimensional printer to  | 
| 9 |  |  create a prototype of a firearm. As used in this paragraph  | 
| 10 |  |  (3), "prototype" means a sample, model, or release of a  | 
| 11 |  |  product built to test a concept or process or to act as a  | 
| 12 |  |  thing to be replicated or learned from the sample, model,  | 
| 13 |  |  or release. "Prototype" includes: | 
| 14 |  |    (A) a sample, model, or release used to test some  | 
| 15 |  |  aspect of the design without attempting to exactly  | 
| 16 |  |  simulate the visual appearance,
choice of materials,  | 
| 17 |  |  or intended manufacturing process; | 
| 18 |  |    (B) a sample, model, or release used to explore the  | 
| 19 |  |  basic
size, look, and feel of the product without  | 
| 20 |  |  simulating the actual function or exact visual
 | 
| 21 |  |  appearance of the product; | 
| 22 |  |    (C) a sample, model, or release intended to capture  | 
| 23 |  |  the design aesthetic and simulate the
appearance,  | 
| 24 |  |  color, and surface textures of the intended product but  | 
| 25 |  |  which does not actually
embody the functions of the  | 
| 26 |  |  final product; or |

| 1 |  |    (D) a functional prototype or working prototype  | 
| 2 |  |  which, to the greatest extent
practical, attempt to  |

| 4 |  |  functionality of the
intended design. | 
| 5 |  |  (c) Sentence. Unlawful use of a three-dimensional printer
 | 
| 6 |  | to create a firearm is a Class A misdemeanor.".
