| 2 |  |  AMENDMENT NO. ______. Amend House Bill 1155, AS AMENDED, by  | 
| 3 |  | inserting the following in its proper numeric sequence:

| 4 |  |  "Section 3. Act implementation.  | 
| 5 |  |  (a) Notwithstanding any other provision to the contrary,  | 
| 6 |  | this Act shall be fully implemented no later than on January 1,  | 
| 7 |  | 2016; however, the Act may be implemented and licenses to carry  | 
| 8 |  | may be issued under this Act prior to January 1, 2016, if a  | 
| 9 |  | report is issued to the General Assembly prior to January 1,  | 
| 10 |  | 2016 from the Department of State Police, Department of Human  | 
| 11 |  | Services, and Illinois Association of Circuit Court Clerks,  | 
| 12 |  | indicating that the agencies and association have adopted,  | 
| 13 |  | addressed, and remedied the findings of the Illinois Auditor  | 
| 14 |  | General's Report from April 2012. |

| 16 |  | indicated that there was a lack of reporting by circuit court  | 
| 17 |  | clerks, with only 3 of 102 counties submitting mental health  |

| 1 |  | court orders to the Department of State Police as required by  | 
| 2 |  | the Firearm Owners Identification Card Act, and that 27 of the  | 
| 3 |  | 121 orders that were issued by the circuit courts were not  | 
| 4 |  | properly reported by the Department of State Police to the  | 
| 5 |  | federal National Instant Criminal Background Check System  | 
| 6 |  | (NICS) database. The report further indicated that the  | 
| 7 |  | Department of Human Services did not properly distinguish  | 
| 8 |  | between voluntary and involuntary admissions to mental health  | 
| 9 |  | service facilities, and therefore the Department of State  | 
| 10 |  | Police could not distinguish between disqualifying mental  | 
| 11 |  | health admissions among persons possessing a Firearm Owner's  | 
| 12 |  | Identification Card. Finally, among those persons possessing a  | 
| 13 |  | Firearm Owner's Identification Card who did have  | 
| 14 |  | disqualifications reported, only 30% of those persons  | 
| 15 |  | disqualified under the Firearm Owners Identification Card Act  | 
| 16 |  | actually returned their revoked Firearm Owner's Identification  | 
| 17 |  | Cards to the Department of State Police. Implementation of this  | 
| 18 |  | Act will present similar reporting issues and therefore cannot  | 
| 19 |  | be effectively implemented until a remedy for the Firearm  | 
| 20 |  | Owners Identification Card Act problems are completed and  | 
| 21 |  | similar remedies can be applied to implementation of this Act. | 
| 22 |  |  (c) If no report is issued as provided under subsection (a)  | 
| 23 |  | of this Section prior to January 1, 2016, the Department of  | 
| 24 |  | State Police may not issue licenses to carry under this Act  | 
| 25 |  | until on and after January 1, 2016.".
